UAE court refuses to extradite Gutpa Brothers to South Africa

The South African government said that its request for the extradition of the Gupta brothers – Atul and Rajesh- who were charged with massive corruption scandals during former president Jacob Zuma, has been refused by a court in the United Arab Emirates. A Dubai court decided not to allow the extradition of the two brothers arrested in the same city in June.

The two Guptas, along with a third sibling  Ajay are accused of looting the state coffers, with the complicity of Mr. Zuma, during his nine years in power between 2009 and 2018. South Africa made a request in July, for extradition shortly after the brothers were arrested in Dubai. There are several cases of corruption against the Gupta brothers, including a questionable public contract worth the equivalent of €1.5 million.

The UAE court found that it could exercise jurisdiction over the money laundering charges against the two brothers, as the offenses were committed both in the country and in South Africa. On the fraud and corruption charges, the court ruled that the arrest warrant had been canceled without adducing any specific reasons.

This is a major setback for South Africa in its effort to investigate the alleged massive corruption that took place during the regime of Jacob Zuma, who is the immediate predecessor of Cyril Ramaphosa.
