SA’s Supreme Court sends notice to government on appeal by tobacco lobby

· The Registrar of the Supreme Court of Appeal has directed President Cyril Ramaphosa to deliver his answering affidavit in an application for leave to appeal brought by the Fair-Trade Independent Tobacco Association (FITA) before Friday 7 August at 15:00

· FITA approached the Supreme Court of Appeal aggrieved by the decision of the North Gauteng High Court, which dismissed its legal challenge to the ban on tobacco sales

The Registrar of the Supreme Court of Appeal has directed President Cyril Ramaphosa to deliver his answering affidavit in an application for leave to appeal brought by the Fair-Trade Independent Tobacco Association (FITA) before Friday 7 August at 15:00.

FITA approached the Supreme Court of Appeal aggrieved by the decision of the North Gauteng High Court, which dismissed its legal challenge to the ban on tobacco sales.

FITA also will have to file replying affidavit to that of Ramaphosa, if any, before 3 PM on 11th August 2020. Experts say that it would be a crucial hearing. FITA feels that since the South African government is progressively lifting the ban imposed, it might have a fair chance to get a favorable decision.
