In preparation for the General Elections in 2025, Malawi Electoral Commission (MEC) proposes to present three Bills, on Electoral Law Reforms, in Parliament during November 2022 sitting. Prior to presenting the bills, they will be published in the Gazette this month as per the requirements of the tabling of bills before the National Assembly. MEC’s Chief Elections Officer, Andrew Mpesi revealed that the Minister of Justice and Constitutional Affairs has assured the Commission that the Bills will be tabled in the Parliament.
The proposed amendments to the electoral laws mainly include The Constitution (Amendment) Bill, 2022, Electoral Commission (Amendment) Bill, 2022, and Presidential, Parliamentary and Local Government Elections Bill, 2022. The Bill according to reports aims to consolidate and harmonise into one single legislation, the various provisions in the Parliamentary and Presidential Elections Act and the Local Government Elections Act. This is expected to improve the efficiency and management of elections.
As part of its exercise to prepare for the 2025 elections, the Legal Services Committee of the Electoral Commission had identified and made recommendations on specific provisions in the electoral legal framework that require reform through legislative amendments. The commission also formed a joint National Task Force on Electoral Reforms with representatives from other stakeholders. The National Task Force came up with a consolidated set of recommendations that were then submitted to the Ministry of Justice and Constitutional Affairs.
